General Terms and Conditions (GTC)
Last updated: October 10, 2026
Please read these terms carefully before using Hozvik Cloud's services. They apply to all of our hosting products, including VPS, shared hosting, cloud hosting, game servers, bot hosting (including Discord and Telegram bots), mail servers, and dedicated servers.
1. Acceptance of Terms
Welcome to Hozvik Cloud. These General Terms and Conditions ("Terms" or "GTC") govern the contractual relationship between Hozvik Cloud ("we", "us", "our") and its customers, including your use of VPS hosting, shared hosting, cloud hosting, game server hosting, bot hosting (including Discord and Telegram bots), mail server hosting, dedicated servers, domain registration, and related infrastructure services.
By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.
2. Legal Documents and Order of Precedence
Your agreement with Hozvik Cloud consists of these GTC together with the following documents, each of which forms part of it:
- Privacy Policy — how personal information is collected, used, and protected.
- Refund Policy — refund eligibility, paid and free credits, domains, and compensation for service anomalies.
- Customer Rights — the rights customers can expect, and their reasonable limitations.
- Service Level Agreement (SLA) — uptime targets and service credits.
- Acceptable Use Policy — the section “Service Usage and Acceptable Use” of these GTC.
- Service-specific terms — terms shown on a product, plan, or order page, and the service-specific sections of these GTC (Game Server and Minecraft Hosting, Bot Hosting, Student Developer Pack, VPS Hosting).
If these documents conflict, the following order applies, from highest to lowest priority:
- 1) Terms stated for the specific product, plan, or order.
- 2) The Refund Policy for refund matters, the SLA for uptime and service credits, and the Privacy Policy for personal data matters.
- 3) These GTC, including their service-specific sections.
- 4) Customer Rights, which is always read together with, and subject to, these GTC.
Mandatory provisions of applicable law always apply. Some topics, such as credit refunds, are described both in these GTC and in the Refund Policy; both are intended to be read together.
3. Definitions
- "Service" refers to all hosting, infrastructure, and related products provided by Hozvik Cloud.
- "User" or "Client" refers to any individual or entity that registers for or uses our services.
- "Account" refers to the user's registered account on our client portal at billing.hozvikcloud.de.
4. Eligibility
You must be at least 18 years old to use our services. By creating an account, you represent and warrant that you are of legal age and possess the legal capacity to enter into a binding agreement.
Minors may only use our paid services subject to the guardian-consent process described in the section Minors and Legal Capacity.
5. Minors and Legal Capacity
- a) The conclusion of contracts is generally only permitted for persons with full legal capacity (18 years and older).
- b) Minors (persons under 18 years of age) require verifiable consent from their legal guardian (usually a parent) to conclude a contract.
- c) Before concluding a contract, the consent form ("Authorization Slip") provided by Hozvik Cloud must be fully completed, signed, and sent to legal@hozvikcloud.de. Hozvik Cloud reserves the right to verify the identity and authorization of the signatories. A contract is only concluded following a positive review and our express acceptance.
Existing minor customers. Existing customers who are minors and who have not yet provided the required declaration of consent from their legal guardian must submit such consent within thirty (30) days after these Terms enter into force, to legal@hozvikcloud.de.
Failure to provide the required consent within the specified period may result in the temporary suspension of the customer account until the matter has been clarified. During such suspension, payout requests may be refused or placed on hold until the required consent and account status have been verified.
6. Services
Hozvik Cloud provides web hosting, game server hosting, VPS hosting, mail server hosting, bot hosting (including Discord and Telegram bots), and dedicated server services. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.
Not every service named above is available at all times. The services currently offered, and any service marked as “coming soon” or “upcoming”, are shown on our website. A service that is not yet offered cannot be ordered, and listing it in these Terms does not create an obligation to launch it.
7. Ordering and Contract Formation
- 1) Orders may be placed through our billing portal or, where offered, through a ticket in our official Discord server (for example VPS hosting requests and Student Developer Pack claims).
- 2) Showing a service, plan, or price on our website or in Discord is an invitation to order, not a binding offer. A contract is concluded when Hozvik Cloud accepts your order, for example by confirming it or by provisioning the service.
- 3) Hozvik Cloud may decline or cancel an order, for example because of suspected fraud, failed verification, a pricing or listing error, or lack of capacity. Any payment received for an order that is declined before the service is provisioned will be returned.
- 4) Prices and plan specifications may change over time. A change does not affect a billing period that has already been paid for.
- 5) A service shown as “coming soon” or “upcoming” cannot be ordered, and no contract arises for it until Hozvik Cloud accepts an order after launch.
8. User Registration and Customer Account
- 1) The use of our paid services requires registration and the creation of a customer account. The customer is obliged to provide all data requested during registration truthfully and completely, and to keep it up to date.
- 2) The customer account is personal and non-transferable.
- 3) You are responsible for maintaining the confidentiality and security of your account credentials, especially your password, and for keeping them protected from unauthorized third parties. You are solely responsible for all activities conducted through your account.
- 4) Hozvik Cloud is not liable for any loss or damage arising from your failure to protect your account credentials.
9. Service Usage and Acceptable Use
You agree not to use our services for any unlawful or prohibited purpose, including but not limited to:
- Distributing malware, viruses, or any harmful software
- Conducting DDoS attacks, port scanning, or unauthorized access against third-party systems
- Hosting content that infringes on intellectual property rights
- Sending spam or unsolicited bulk email
- Mining cryptocurrency without prior written approval
- Hosting content related to illegal activities under Indian or international law
- Running Tor exit nodes or open proxies without prior approval
We reserve the right to suspend or terminate any account that violates this acceptable use policy, with or without prior notice, at our sole discretion. Such violations may result in immediate account termination.
This section is Hozvik Cloud’s Acceptable Use Policy, as referred to in the other Hozvik Cloud legal documents. Additional service-specific rules for game server, bot, and Student Developer Pack hosting appear in their own sections below.
10. Customer Content and Responsibility
You are solely responsible for all content, data, software, code, bots, plugins, mods, scripts, configurations, and activity on your service, and for holding all rights and licences needed to use them.
Hozvik Cloud does not routinely review the content of your service. We may investigate, restrict, or remove content or access where we receive a report or legal request, or where it is necessary for security, to prevent abuse, or to enforce these Terms.
Reports of abuse or infringement can be sent to legal@hozvikcloud.de. We may require the affected content to be removed, and repeated or serious violations may lead to suspension or termination of the account.
11. Game Server and Minecraft Hosting
These terms apply to game server hosting, including Minecraft (Java and Bedrock), in addition to the rest of these GTC and the resource overload rules below.
- Publisher rules. You must follow the terms of the game publisher, for example the Minecraft EULA and the Minecraft Usage Guidelines. Hozvik Cloud does not provide game licences unless this is explicitly stated.
- Plugins, mods and modpacks. You are responsible for the licensing, compatibility, and safety of plugins, mods, modpacks, and resource packs. One-click installs are offered for convenience and are provided as-is by third parties; Hozvik Cloud is not responsible for bugs, incompatibilities, or data loss caused by them.
- Running your server. You are responsible for your server’s configuration, moderation, player conduct, in-game content, and any monetisation, and these must comply with the publisher’s rules and applicable law.
- Slots. Where a plan is described as having “unlimited slots”, Hozvik Cloud does not set a player-slot cap. The number of players a server can actually support depends on its allocated resources, and the resource rules still apply.
- Worlds and data. You should keep your own backups of worlds and configuration files, as set out in the Data and Backups section.
- DDoS protection. Protection is provided on a reasonable-efforts basis and cannot guarantee protection against every attack. Hozvik Cloud may filter traffic or temporarily restrict a service where this is needed to protect its infrastructure or other customers.
- Availability of games. The games offered, and the features available for each, may change over time.
12. Meta Migration System (Resource Overload)
Guidelines for handling resource overload on paid game servers.
- 1) Overload handling. If you have a paid server and it experiences an overload, action is taken based on your allocated resources. For example, if your server is configured with 5 GB and usage extends 1 GB beyond that limit, a temporary 1 GB grace allowance may be granted free of charge, subject to certain conditions.
- 2) Usage spikes. No action is taken for temporary spikes in server usage, especially during server startup. Action is only initiated once usage consistently exceeds the defined limit.
Warning and suspension process
- 1st Warning: A notice is sent once your server exceeds its usage limit.
- 2nd Warning: A final warning is issued, along with a final notice period.
- 3rd Warning: Following the second warning, your service will be suspended after 3 warnings in total.
Overload overview. All official customers of Hozvik Cloud who purchase a server are subject to the specific overload terms outlined below. Please read them carefully before use.
| Server plan | Overload extender | Total with extender | Orange zone (max load) | Red alert and warning |
|---|---|---|---|---|
| 4 GB | 500 MB | 4.5 GB | Up to 5 GB | Beyond 5.5 GB |
| 6 GB | 500 MB | 6.5 GB | Up to 7 GB | Beyond 7.5 GB |
| 8 GB | 500 MB | 8.5 GB | Up to 9 GB | Beyond 9.5 GB |
| 12 GB | 1000 MB | 13 GB | Up to 13.8 GB | Beyond 14.2 GB |
| 16 GB | 1000 MB | 17 GB | Up to 18 GB | Beyond 18.2 GB |
| 25 GB | 2000 MB | 27 GB | Up to 27.8 GB | Beyond 28.2 GB |
| 34 GB | 2000 MB | 36 GB | Up to 37 GB | Beyond 38.2 GB |
| 58 GB | 3000 MB | 61 GB | Up to 62 GB | Beyond 63 GB |
| 64 GB | Unlimited RAM and space | |||
| Unlimited Space | Unlimited RAM and space | |||
Note: This overload allowance applies to virtualized RAM only. For example, if your allocated plan is 34 GB, load extending up to 37 GB is not considered an overload and does not add to your actual RAM slot.
13. Bot Hosting
These terms apply to bot hosting plans, including bots for Discord, Telegram, and other supported platforms, in addition to the rest of these GTC.
- Intended use. Bot hosting is for running legitimate bots and the applications that support them.
- Prohibited use. In addition to the Acceptable Use Policy, you must not use a bot service for spam or mass or unsolicited messaging; raiding, nuking, or harassment; token grabbing, credential theft, or phishing; automating user accounts (“self-bots”) in breach of platform rules; abusing or scraping platform APIs beyond what the platform allows; or running proxies, VPNs, port scanners, cryptocurrency miners, or other workloads unrelated to your bot and its supporting services.
- Platform rules. You must comply with the terms and developer policies of every platform your bot uses. Hozvik Cloud is not affiliated with those platforms and is not responsible for bans, rate limits, API changes, or the removal of your bot by a platform.
- Tokens and secrets. You are responsible for keeping bot tokens, API keys, and environment variables secret. If one is exposed, you should regenerate it immediately. Hozvik Cloud is not liable for misuse of credentials that you disclose.
- Plan limits. The RAM, storage, and backup limits of your plan are the limits of your service. If your bot exceeds them, its processes may be restarted or stopped, and repeated or severe overuse may lead to suspension.
- CPU and fair use. Where a plan is described as including unlimited CPU, no fixed CPU cap is set for it, subject to fair use. CPU use that harms the shared infrastructure or other customers may be throttled, limited, or stopped.
- Continuous operation. “24/7 hosting” means your bot is intended to run continuously. Interruptions can still occur because of maintenance, upstream provider issues, or infrastructure events; see the SLA section.
- Runtimes and tools. Runtimes, eggs, one-click services, and similar tools are provided as-is and may be subject to their own licences. Their availability may change.
14. Student Developer Pack
The Student Developer Pack is a free promotional offer that gives eligible students a Starter Bot Hosting plan. It is provided at Hozvik Cloud’s discretion, and these terms apply in addition to the Bot Hosting terms and the rest of these GTC.
- 1) How to claim. Open a ticket in the “Student Pack” category of our official Discord server and provide the information requested by the Hozvik Cloud team.
- 2) Verification. To verify your student status you must provide a photo of your college ID card and your enrolment number. The information must be true, current, and your own. Hozvik Cloud may approve or decline a claim, ask for more information, or request re-verification at any time, and approval is not guaranteed.
- 3) One per student. The pack is limited to one per eligible person, and Hozvik Cloud may set further limits, for example per institution. If you are under 18, the section Minors and Legal Capacity applies as far as relevant.
- 4) Misuse. Providing false, forged, or another person’s documents, claiming more than once, or sharing, selling, or transferring the pack may lead to the claim being declined, or to suspension or termination of the service, and Hozvik Cloud may report the matter to the competent authorities.
- 5) Free service. The pack has no cash or credit value, cannot be transferred, and is not eligible for payout. Because no payment is made, no refund applies. Hozvik Cloud may change, limit, suspend, or discontinue the offer or an individual pack with reasonable notice, and the limits of the plan are those shown for Starter Bot Hosting on our website.
- 6) Your information. Verification information is handled as described in the Privacy Policy and is used only for verification and fraud prevention.
15. VPS Hosting (Upcoming)
VPS plans are upcoming and are not listed on our website yet. Customers who need an official Hozvik Cloud VPS can submit a VPS hosting request through a ticket in our official Discord server.
- Submitting a request is not an order. It does not guarantee availability, pricing, or provisioning, and a contract is concluded only when Hozvik Cloud accepts and confirms your order.
- Once a VPS has been individually provisioned or reserved for you, the Refund Policy for individually provisioned VPS resources applies. Such a service may be non-refundable, so please read it before you pay.
- Features and specifications described for VPS hosting before launch may change.
16. Data and Backups
While Hozvik Cloud implements reasonable backup systems, users remain ultimately responsible for maintaining their own backups. We strongly recommend that all clients keep independent copies of their data. Hozvik Cloud shall not be held liable for any resulting data loss.
Purchased cloud backups. Automated cloud backups, where purchased, fall under Hozvik Cloud's responsibility; backups maintained independently by the client remain the client's own responsibility. Should Hozvik Cloud fail to deliver on a purchased cloud backup service, compensation of 1 to 10 additional days' renewal credit toward the affected game server may be provided.
17. Service Level Agreement (SLA)
Hozvik Cloud targets 99.9% uptime across its core infrastructure. Detailed SLA terms, including the service credit calculation methodology, are outlined separately in our dedicated SLA channel on our Discord community: SLA channel.
18. Third-Party Services and Upstream Providers
Hozvik Cloud may rely on upstream data centers, network providers, domain registrars, payment processors, and software or licence providers. Their own terms may apply to parts of the service, and their failures or restrictions can affect it.
To the extent permitted by law, Hozvik Cloud is not liable for failures of third-party services outside its reasonable control. How third-party costs affect refunds is explained in the Refund Policy.
19. Billing and Payment
- All services are billed in advance on a recurring basis, in Indian Rupees (INR) or USD.
- Payment methods include UPI, credit/debit cards, net banking, and other payment gateways as available.
- Services must be renewed before their due date to avoid suspension or termination.
- Overdue invoices may result in service suspension following a 3-day grace period.
- You agree to pay all applicable fees. Failure to pay may result in suspension or termination of your services.
20. Credit and Payout
Credit held in the customer account is intended exclusively for settling payments for services at Hozvik Cloud. A payout is only possible upon the customer's express request and subject to the fulfilment of the conditions set forth below.
Prerequisites for a payout
- a) A minimum credit balance of ₹400 deposited by the customer.
- b) Successful and legally compliant identity verification of the customer.
- c) No active products or outstanding claims on the account.
Meaning of credits
- One category of credit represents verified funds used to purchase any service through a single-click buy option.
- Deposited credit may be refunded within 5 days of payment, provided it has not yet been used to book or consume any Hozvik Cloud services. Once partially or fully used, a refund is no longer available.
- Credits received free of charge are not eligible for refund, and any loss of such credits cannot be recovered, in accordance with this GTC.
- In the event of a payment chargeback, associated credits and services may be suspended, and the account may also be subject to termination.
- Payouts shall be made exclusively to a bank account held in the customer's name. Transfers to international accounts are permissible, provided the customer's identity has been unequivocally verified.
21. Account Termination and Remaining Credits
In the event of account termination by Hozvik Cloud for good cause, including but not limited to a material breach of these Terms, payment default, fraud, or attempted fraud, any remaining promotional or non-refundable credit may be forfeited. Deposited and unused funds shall remain eligible for payout, subject to these Terms.
Hozvik Cloud reserves the right to offset any remaining credit against outstanding payments, claims, costs, or demonstrable damages owed by the customer. Where the customer voluntarily deletes their account, they may request a payout of eligible deposited and unused funds in accordance with the applicable payout provisions.
22. Fraud and Abuse
Hozvik Cloud reserves the right to refuse or suspend a payout where there are reasonable and concrete indications of fraud, abuse, manipulation, or other unlawful activity. Where appropriate, Hozvik Cloud may report such matters to the competent authorities.
23. Payout Processing
Payout requests may take up to fourteen (14) business days to process. Where a payout requires verifiable manual review or additional manual transaction effort, Hozvik Cloud may charge a processing fee of EUR 5.00, up to a maximum of EUR 10.00.
24. Excluded Credits
Credits received through bonus campaigns, promotional offers, discounts, referral rewards, goodwill gestures, or similar promotional activities are strictly excluded from payout and cannot be converted into cash or transferred as monetary funds.
25. Suspected System Errors
Where a customer requests a payout or adjustment due to a suspected system error, the customer is required to reasonably cooperate with Hozvik Cloud in investigating and clarifying the matter. This may include providing relevant account information, screenshots, transaction details, communication records, logs, or other evidence reasonably necessary for the review.
26. Community Conduct
Customer conduct
Customers are permitted to communicate firmly and to express their concerns, frustration, or dissatisfaction regarding any issue without facing disciplinary action solely for doing so.
This includes situations where the customer feels that a mistake was made by Hozvik Cloud. If a customer speaks somewhat rudely or sharply in such a situation, but remains within reasonable limits and does not become abusive, no action will be taken against the customer.
However, if a paid user intentionally behaves abusively, disrespectfully, or violates the rules without reasonable cause, appropriate action may be taken in accordance with the abuse provisions of these Terms. Depending on the severity of the violation, this may include a timeout or a permanent ban from the community.
Staff conduct
Founders and Staff are expected to treat customers respectfully at all times. Staff are not permitted to respond rudely or abusively, and should remain professional and avoid unnecessary arguments or escalation.
Should a customer engage in rude or abusive behavior, no corrective action shall be taken against staff in response, as governed by this GTC. Any staff member found violating the GTC or other applicable rules may be subject to appropriate disciplinary action.
Service protection. Any action taken under Community Conduct, including a timeout or a ban, is a community moderation action only. Such an action will never result in the termination or suspension of your paid service on its own. Your servers, billing, and account remain fully active, and you keep access to your service and your data.
Appeals. If you believe an action (a timeout or a ban) was taken against you unfairly or by mistake, you can appeal it at any time. Where an appeal is well founded, the action can be reversed or reduced, and in most first-time cases the action can be waived entirely. You may appeal through any of the following channels:
- Reply in the same conversation or ticket where the action was communicated to you
- Email us at legal@hozvikcloud.de
- Open a support ticket on our billing portal: billing.hozvikcloud.de
- For the fastest response, you may also contact us from a different Discord account, so you can appeal even while your main account is timed out or banned
Every appeal is reviewed in good faith and you will be heard. Submitting an appeal will never be treated as a further violation.
27. Termination
Either party may terminate the service at any time. Upon termination, the user is responsible for retrieving their data before the service end date. Hozvik Cloud reserves the right to delete associated data 7 days following service expiry.
28. Intellectual Property
All content, branding, and materials on hozvikcloud.de and related properties are owned by Hozvik Cloud. You may not reproduce, distribute, or create derivative works from this material without our prior written consent.
29. Disclaimer of Warranties
To the maximum extent permitted by law, our services are provided “as is” and “as available”. Hozvik Cloud does not warrant that the services will be uninterrupted, error-free, or fit for a particular purpose, and, as a startup-stage provider, may experience technical issues from time to time.
Nothing in this section excludes rights that cannot be excluded by law, or the uptime targets and service credits described in the SLA.
30. Limitation of Liability
To the maximum extent permitted by law, Hozvik Cloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with the use of our services.
Our total aggregate liability for any claims arising from the use of our services shall not exceed the total fees paid by you to Hozvik Cloud in the twelve (12) months preceding the claim.
31. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Hozvik Cloud, its owners, and its staff from claims, losses, damages, and reasonable costs (including legal fees) arising from your content, your breach of these Terms, or your violation of the law or of third-party rights.
32. Force Majeure
Hozvik Cloud is not liable for delay or failure in providing the services caused by events beyond its reasonable control, including natural disasters, power or network failures, upstream provider failures, cyberattacks or DDoS attacks, war, civil unrest, government action, epidemics, or labour disputes.
Affected obligations are suspended for as long as the event continues. This does not remove any payment obligation that was already due.
33. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall fall under the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.
34. Severability, Entire Agreement and Notices
- Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions stay in effect.
- No waiver. Not enforcing a provision at any time does not waive our right to enforce it later.
- Entire agreement. These Terms and the documents listed under Legal Documents and Order of Precedence are the entire agreement between you and Hozvik Cloud for the services.
- Assignment. You may not transfer your account or your rights under these Terms without our written consent. Hozvik Cloud may transfer its rights and obligations as part of a business transfer.
- Notices. We may send notices to the email address on your account, post them on our website or billing portal, or announce them in our official Discord server. Legal notices to Hozvik Cloud should be sent to legal@hozvikcloud.de.
35. Changes to Terms
Hozvik Cloud reserves the right to update these Terms at any time. Changes take effect immediately upon being posted to this page. Continued use of our services following any such changes constitutes acceptance of the updated Terms. We will notify users of significant changes via email.
